Beneficiary living in a foreign nation
03/01/07 at 10:14:59

Hi,

I am an immigrant to the U.S., who has since attained permanent residency.  I recently received a life insurance policy through my employer.  I named my beneficiary to be my only son.  My son is 16 years old, and still lives in our home country.  I am worried that if I die, my states' laws may prohibit out of country beneficiaries from receiving benefits.  Do I have any reason to be worried?

Thank you,

Jorge

sorry jorge, i don't think your son will be able to receive the benefits of your policy.  to my best knowledge, I would say he would have to be living in the same country as the insurance company in order to receive the money.

Gonna have to disagree with amanda on this one.  I have never heard of any such law.  I don't think it would matter where your son lives.  To be sure,  I would suggest checking with your states' own department of insurance. Here is a link to a website where you can find your own states' dept:

I think nash is right on with this one (BTW is your first name Steve?). Anyway, you may want to consider naming an adult guardian as the beneficiary. I'm not sure what your home country is, but why risk leaving that kind of jack to a minor.

That is a good point about naming an adult guardian (that you trust of course) as beneificary. You can also set up a trust which would give you control over how the death benefit would be used to care for your child.
